Terms of Service

Introduction

These Terms of Service ("Terms") govern your access to and use of our SaaS platform, including AI-driven quoting tools, interactive maps, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Quote Maker Pro is dedicated to assisting landscapers in streamlining their operations. We reserve the right to update these Terms at any time; your continued use constitutes acceptance of any changes.

Acceptance and Accounts

To use the Service, you must be at least 18 years old and capable of forming a binding contract. By registering, you represent that you meet these requirements and the eligibility requirements in the Eligibility and Geographic Scope section below.

You are required to create an account with accurate information and are responsible for maintaining its security and all activities that occur under it. Notify us immediately of any unauthorized access.

Use of the Service

You may use the Service only for lawful purposes. Prohibited activities include misusing AI tools, violating applicable laws, or interfering with the Service's operation.

We grant you a limited, non-exclusive, non-transferable license to use the Service. You retain ownership of your data but grant us the necessary rights to process it for providing the Service.

Your use is also subject to our Fair Use Policy, which describes ordinary commercial use per business, multi-channel sharing of quote links, and prohibited abuse (including automation and multi-tenant reselling of a single seat).

Fair Use Policy

Subscriptions are billed per business. Each business gets a shareable quote link. You may use that link on Facebook, your website, or anywhere else for that business. Additional brands or locations require additional businesses on your plan.

Each business’s quote map uses a drive radius from its service center. We cap that radius (currently 150 miles in the US, or 250 km elsewhere) so the Service stays a local quoting tool, not a nationwide lead net. We may apply rate limits and other technical controls, and we may suspend or terminate accounts that abuse SMS, maps, AI, or the Service (including using one subscription to serve many unrelated companies). Eligibility and Geographic Scope

The Service is offered only to businesses located in the United States and in Canada, excluding the province of Quebec. We do not offer, market, or provide the Service to businesses based in Quebec, and the Service is not intended for use by Quebec-based businesses.

Without limiting the foregoing, you may not create an account, subscribe, or use the Service as a business customer if:

• your principal place of business, registered office, or headquarters is in Quebec;
• your business is organized or primarily operated in Quebec; or
• you are otherwise a Quebec-based business seeking to use the Service for commercial operations in Quebec.

By registering for an account, starting a free trial, or purchasing a subscription, you represent and warrant that your business is not based in Quebec and does not primarily operate in Quebec, and that you meet the geographic eligibility requirements of this section.

If we determine (or reasonably believe) that you are a Quebec-based business or that you are using the Service in violation of this section, we may refuse registration, suspend or terminate your account, cancel your subscription, and/or deny access to the Service, without liability to you except as required by law (including any refund rights that may apply under our refund policy or applicable law).

This geographic restriction applies to business customers who create accounts and use Quote Maker Pro for their operationsok . It does not by itself prohibit an end homeowner or visitor outside Quebec from interacting with a quote experience that a non-Quebec customer has lawfully published.

Payments and Subscriptions

Subscriptions are managed and billed through the Stripe Customer Portal. Pricing is generally per business (quantity on your plan). We offer a 14-day no-questions-asked refund period for new subscriptions. After this period, payments are non-refundable except as required by law. We may adjust pricing with prior notice, and you are responsible for any applicable taxes.

“Unlimited quotes” under ordinary commercial use does not waive our Fair Use Policy or technical limits designed to prevent abuse.

Additional Legal Provisions

• Intellectual Property: The Service, including its AI models and tools, is our proprietary property. You may not copy, modify, distribute, or reverse-engineer any part of it without prior written permission.
• Termination: We may suspend or terminate your account for violations of these Terms. Upon termination, your access to the Service will cease, but any outstanding obligations, such as payments, will remain.
• Limitation of Liability: The Service is provided "as is" without warranties. We are not liable for indirect, consequential, or punitive damages, including lost profits or data. Our total liability is limited to the amount of fees paid by you in the preceding 12 months.
• Governing Law: These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.
• Changes to Terms: We may revise these Terms at any time. Your continued use of the Service after changes constitutes your acceptance.
